エルシーピー投資法人（LCP)が、平成19年8月期末の上位投資主の保有比率が50％を超過していたことを発表した。これは、投資主名簿管理人である中央三井信託銀行からLCPが9月13日に大口投資主一覧を受け取ったことに伴い判明した。 J-REITは、上位3社投資主比率が50％を超過した場合、投資法人の利益に対して法人税等が課税されることになる。従ってLCPの平成19年8月末時点の投資主への分配金が、法人税等が課税されることに伴い、40％程度減少する可能性が生じたことになる。 LCPは、上位3社中の2社の保有分が信託口名義等であり、複数の実質的な投資主のためのものと考えており、実質的な投資主を調査するとともに税務顧問とも協議するとしている。従って、現時点では投資法人への法人税等の課税は確定していないため、平成19年8月期の1口あたり予想分配金は12,800円のまま据え置いている。
