エスコンジャパンリート投資法人の資産運用会社であるエスコンアセットマネジメントに対する行政処分が決定した。 鑑定会社への不適切な働きかけ、鑑定会社の選定方法が金商法の忠実義務に違反すると認められ、金融庁より業務停止命令と業務改善命令を受けた。 業務停止命令は、7月15日から3ヶ月間、新たな資産運用委託契約の禁止、不動産の取得に関わる運用指図の禁止。これによりEJRは3ヶ月間新たに物件取得が出来ないが、既存物件の運用への影響はないため、EJRの業績予想の修正はなし。 業務改善命令は、業務運営方法の見直し、再発防止策の策定、経営陣の責任の明確化等を図り、書面で報告すること。 これを受けて、エスコンアセットマネジメントは、スポンサーの影響を排除することが困難なガバナンス体制であったことを認識し、鑑定を含めた物件取得業務の再構築、組織変更を行う。また予定していた私募REIT組成を中止することを発表した。
