証券取引等監視委員会は、エスコンジャパンリート投資法人の資産運用会社であるエスコンアセットマネジメント（EAM）に対し行政処分を行う旨、金融庁に勧告した。 EAMは、スポンサー等の利害関係人との不動産取引において、特定の鑑定会社に対し鑑定評価額の引き上げや鑑定報酬の引き下げの不適切な働きかけを行い、鑑定会社を選定していた。鑑定会社の独立性を損うことから、金商法の忠実義務に違反すると認められた。
